Terms & Conditions

The following constitute the terms and conditions to which applicants agree when booking any e-Learning courses (Terms and Conditions). Throughout the terms and conditions the Vivaanta Education Institute stands. The Vivaanta Education Institute reserves the right to review and update these periodically.

  1. REGISTRATION WITH THE VIVAANTA EDUCATION INSTITUTE (CREATING AN ACCOUNT)

    When booking onto a training or eLearning course we require you to register to create an account and provide us with certain information about yourself. In doing this, you agree to:

    1. Provide true, accurate, current and complete information about yourself as prompted by the registration form. It is your sole responsibility to ensure that the account information provided by you is accurate, complete and latest.

    2. Maintain and promptly update the data we hold by logging into your account and updating via ‘My profile’.

    3. You shall be responsible for maintaining the confidentiality of the account information and for all activities that occur under your account. You agree to (a) ensure that you successfully log out from your account at the end of each session; and (b) immediately notify Vivaanta Education Institute of any unauthorized use of your account. If there is reason to believe that there is likely to be a breach of security or misuse of your account, we may request you to change the password or we may suspend your account without any liability to Vivaanta Education Institute, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from your failure to comply with this provision.

    4. You acknowledge that your ability to use your account is dependent upon external factors such as internet service providers and internet network availability and cannot guarantee accessibility to the website at all times. In addition to the disclaimers set forth in the Terms, the institute shall not be liable to you for any damages arising from your inability to log into your account and access the services of the website at any time.

    5. Persons who are minors, un-discharged insolvents etc. are not eligible to register for our products or Services. As a minor if you wish to use our Services, such use shall be made available to you by your legal guardian or parents, who has agreed to these Terms. In the event a minor utilizes the Website/Services, it is assumed that he/she has obtained the consent of the legal guardian or parents and such use is made available by the legal guardian or parents. Vivaanta Education Institute will not be responsible for any consequence that arises as a result of misuse of any kind of Our Application or any of Services that may occur by virtue of any person including a minor registering for the Services provided.

  2. BOOKING AN ELEARNING COURSE

    1. Training and eLearning courses can be booked via the booking forms available on Vivaanta Education Institute website. You need to be registered with Vivaanta Education Institute before you can do this as you will be required to log in or create your account to complete the form.

    2. When you submit a booking, your submission represents an offer to Vivaanta Education Institute to book you onto the course you selected. On submission of the training course or eLearning course form you will receive an automated summary email of your selection.

    3. Vivaanta Education Institute will accept your offer by entering your booking onto the Vivaanta Education Institute system and sending you an email confirming that you have been booked together with information on starting your learning.

  3. PRICING AND PAYMENT

    1. Notice of new pricing will be given in advance, but Vivaanta Education Institute reserves the right to change prices listed without notice.

    2. The training course fees include: training on the day(s), all relevant course materials.

    3. Fees must be paid at the point of booking via secure online payment process. If you have an applicable discount code this must be entered at the time of booking, as the discount cannot be applied retrospectively.

    4. We accept, Mastercard and Visa card payments. A receipt will be sent to you by email from Vivaanta Education Institute confirming payment. Vivaanta Education Institute will receive the information needed to verify and authorise your payment card and to process your order and is under strict legal and contractual obligations not to disclose this information to third parties. Please note that if you do not provide accurate details (including type of card and number) or if your credit card company does not authorise payment, your application will be deemed void. Vivaanta Education Institute will not accept any liability for costs incurred as a result of applications deemed void in this manner.

    5. Taxes are charged at the applicable rate depending on the product and/or customer.

    6. We cannot invoice for fees, or accept payment, by installments.

  4. PREVAILING TERMS AND CONDITIONS

    Please note that this and all other Vivaanta Education Institute pre-contractual documentation shall not constitute an offer. All services provided by Vivaanta Education Institute are on the basis of these Terms and Conditions and if you wish to engage any Vivaanta Education Institute services we shall only provide them if you accept the Terms and Conditions. If you offer to engage Vivaanta Education Institute on your own terms and conditions then we shall only accept your offer subject to the Terms and Conditions, which shall, if we provide the services you offer to engage, prevail over any other terms and conditions.

  5. VIVAANTA EDUCATION INSTITUTE LEARNING STUDY SITE

    1. After booking onto a training or eLearning course you will be given access to the study site. For eLearning, you will be given a license period of 90 days when purchasing an individual unit, and 365 days when purchasing an annual license (all seven courses). For training courses, you will be given access from the date you are booked on and then until 60 days after the course start date. By using the site you agree to these terms and conditions. If you do not agree to these terms, you cannot use the site.

    2. Whilst we make every effort to keep changes to the site to a minimum, we reserve the right to make any amendments to the terms and conditions at any time to reflect changes affecting our business, including but not limited to, changes in technology, payment methods and legal and regulatory requirements. By continuing to use this site you agree to accept any changes made to the terms and conditions.

  6. OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS

    All learning materials, whether on the study or on the training day(s), are owned by the Vivaanta Education Institute. All intellectual property rights in all materials available, including the design, graphics and text of all printed materials and the audio of all webinars and podcasts, are owned by Vivaanta Education Institute. When you are given access to the site, you are granted a non-exclusive, non-transferable, revocable license to use the materials. No content may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without the Vivaanta Education Institute prior permission. Any such use is strictly prohibited and will constitute an infringement of Vivaanta Education Institute intellectual property rights.

  7. BEHAVIOR

    Vivaanta Education Institutereserves the right to remove any delegate from a training course whose behavior is deemed inappropriate by Vivaanta Education Instituteor its trainers. In these circumstances, Vivaanta Education Institute will neither refund any fees nor reimburse any other costs.

  8. TRAINERS/EXPERTS

    Vivaanta Education Institute shall provide such trainers/experts to present the training course as it, in its sole discretion, deems fit and Vivaanta Education Institute shall be entitled at any time to substitute any trainer with any other person who, in the Vivaanta Education Institute sole discretion, it deems suitably qualified to present the relevant course.

  9. LIABILITY

    Vivaanta Education Institute does not accept responsibility for anyone acting as a result of information in, or views expressed on, its training courses including course materials. Opinions expressed are those of individual trainers/experts and not necessarily those of Vivaanta Education Institute. Participants should take professional advice when dealing with specific situations.

  10. TECHNOLOGY

    Vivaanta Education Institute does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error-free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.

  11. JOINING INSTRUCTIONS

    Joining instructions including an outline of the day will be available prior to the course start date via the study site Vivaanta Education Institutewill not be held responsible for non-receipt of joining instructions and refunds will not be issued under such circumstances.

  12. GOVERNING LAW & JURISDICTION
    13.

    1. This Agreement shall be governed by and construed in accordance with Indian Contract Act, 1872.

    2. The parties (i) hereby irrevocably and unconditionally submit to the jurisdiction of Subordinates Court of Jagraon for the purpose of any suit, action or other proceeding arising out of or based upon this Agreement, (ii) agree not to commence any suit, action or other proceeding arising out of or based upon this Agreement except in Subordinate Courts of Jagraon, and (iii) hereby waive, and agree not to assert, by way of motion, as a defense, or otherwise, in any such suit, action or proceeding, any claim that it is not subject personally to the jurisdiction of the above-named courts, that its property is exempt or immune from attachment or execution, that the suit, action or proceeding is brought in an inconvenient forum, that the venue of the suit, action or proceeding is improper or that this Agreement or the subject matter hereof may not be enforced in or by such court.

  13. LIMITATION OF LIABILITY

    1. To the fullest extent permitted by law, in no event shall Vivaanta Education Institute, its affiliates, their respective officers, employees, or agents, be liable to you for any direct,indirect, incidental, special, punitive, losses or expenses or consequential damages whatsoever resulting from any

      • errors, mistakes, or inaccuracies of user-generated content or any other content available at vivaanta education institute,
      • personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our institute platforms,
      • any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein,
      • any interruption or cessation of transmission to or from vivaanta education institutewebsite,
      • any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our website by any third party, and/or
      • any errors or omissions in any user-generated content or any other content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via vivaanta education institute, whether based on warranty, contract, tort, or any other legal theory, and whether or not vivaanta education institute is advised of the possibility of such damages.

    2. we understand that, in some jurisdictions, warranties, disclaimers and conditions may apply that cannot be legally excluded, if that is true in your jurisdiction, then to the extent permitted by law, Vivaanta Education Institute and its affiliates limit their liability for any claims under those warranties or conditions to supplying you the Vivaanta Education Instituteplatform again.
    3. you specifically acknowledge that Vivaanta Education Institute shall not be liable for user- generated content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
    4. the vivaanta education institute platform is controlled and offered by vivaanta education institute and / or its affiliates depending upon your jurisdiction. vivaanta education institute makes no representations that the vivaanta education institute platform is appropriate or available for use in other locations. those who access or use the vivaanta education instituteplatform from other jurisdictions do so at their own volition and are responsible for compliance with local law.
  14. COMPLETION OF COURSE

    Digital certificate of the affiliated course shall be issued to you after the completion of the course. The certificate will be digitally signed by the trainer/expert along with the attestation of Vivaanta Education Institute. The Digital certificate will be provided in account of the Vivaanta Education Institute website and it will also be emailed to you at your registered website.

  15. GENERAL PROVISIONS

    1. Legal Notices: In the event of any other disputes or claims arising from the use of the Vivaanta Education Institute Platform, please get in touch with us at www.vivaanta.in

    2. Modification, Amendment or Termination: Vivaanta Education Institute may, in its sole discretion, modify or revise the Agreement and policies at any time, and you agree to be bound by such modifications or revisions. Your continued use of the Platform post any modification of the Agreement shall be taken as your consent and acceptance to such modifications. Nothing in the Agreement shall be deemed to confer any third-party rights or benefits. You are advised to check our Platform frequently to see recent changes and to keep yourself updated with the most recent updates.

    3. Force Majeure: Vivaanta Education Institute shall not be liable for failure to perform, or the delay in performance of, any of its obligations if, and to the extent that, such failure or delay is caused by events substantially beyond its control, including but not limited to acts of God, acts of the public enemy or governmental body in its sovereign or contractual capacity, war, terrorism, floods, fire, strikes, epidemics, civil unrest or riots, power outage, and/or unusually severe weather.

    4. Miscellaneous: If any part of the Agreement is found to be unlawful, void or unenforceable, that part of the Agreement will be deemed severable and will not affect the validity and enforceability of any remaining provisions. Any notice required to be given in connection with the Platform shall be in writing and sent to the registered office of Vivaanta Education Institute. We do not guarantee continuous, uninterrupted or secure access to the Platform, and operation of the Platform may be interfered by numerous factors outside our control. Headings are for reference purpose only an on no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to any breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

  16. VIVAANTA EDUCATION INSTITUTE’S RIGHTS

    In respect of the entire Platform, Vivaanta Education Institute reserves the following rights:

    1. Vivaanta Education Institute reserves the right to put on-hold or reject or suspend or terminate your registration on the Platform for the purpose of complying with the legal and regulatory requirements.

    2. Vivaanta Education Institute reserves the right to remove you and/or the User-generated Content without notice if you violate any provisions of the Platform Terms.

    3. Vivaanta Education Institute may modify, terminate, or refuse to provide Services at any time for any reason, without notice.

    4. Notwithstanding anything contrary stated in the Platform Terms, in its sole discretion, Vivaanta Education Institute may remove anyone from the Platform at any time for any reason.

    5. Vivaanta Education Institute reserves the right to access your account and/or the User-generated Content in order to respond to requests for technical support, to maintain the safety and security of the Platform, legal purposes and for other legitimate business purposes, as necessary, in Vivaanta Education Institute’s discretion.

    6. Vivaanta Education Institute has no obligation to monitor any content that appears on the Platform or review any conduct occurring through the Platform, including any interactions between Users, however, if Vivaanta Education Institute receives notice or becomes aware of, any violation of the Platform Terms, then, Vivaanta Education Institute reserves the right to refuse your access to the Platform, terminate accounts or remove such violating content at any time without notice to you.

  17. PLATFORM AVAILABILITY

    Your access to the Platform may occasionally be suspended or restricted to allow for repairs, maintenance, or due to the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. You agree that Vivaanta Education Institute will not be liable for any losses that may be incurred by you if for any reason all or part of the Platform is unavailable at any time or for any period for use.
